Frugalux provides a service that allows users to monitor the price of products from online retailers. Users can submit a URL of a product they wish to track. Our system will periodically check the product page for price changes and notify the user via email if a price drop is detected.

The Service offers various tiers:

• Free Tier: Users are limited to monitoring a specific number of products.
• Paid Tiers: Subscribing to a paid tier unlocks additional features, such as the ability to monitor more products, higher frequency of price checks, or other premium features as described on our pricing page.

3. User Accounts

• Account Creation: To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
• Account Responsibility: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
• Account Limitation: You may only register one account per email address. Users found to have multiple accounts may lose all associated accounts and any fees you have paid.
• Account Termination by You: You may close your account at any time through your account settings. No fees will be refunded or prorated due to an account termination.
• Account Termination by Us: We may suspend or terminate your account at our sole discretion, without notice or liability, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties.

4. User Data and Privacy

• Data Collection: We collect data necessary to provide the Service, including your email address and the URLs you submit for monitoring.
• No Sale of Data: We are committed to protecting your privacy. We do not and will not sell any personally identifiable data collected from you to any third party.
• Data Purge on Account Closure: Upon the closure or termination of your account, all associated data, including your tracked items and personal information, will be permanently purged from our systems in a timely manner.

5. URL Modification and Affiliate Links

To maintain the functionality and sustainability of our Service, you acknowledge and agree to the following:

• The URLs you submit may be programmatically cleaned or modified to remove non-essential tracking parameters or session information.
• We may append our own affiliate tracking codes to the URLs you provide. When you click on a link from our notification email and make a purchase, we may earn a commission. This helps us offset the operational costs of providing the free tier of our Service. This process does not affect the price you pay for the product.

6. User Responsibilities and Conduct

• You are solely responsible for the URLs you submit and for managing your price alerts.
• You are responsible for canceling any price alerts you no longer wish to receive. The Service will continue to send email notifications for active alerts until you disable them.
• You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or its users.

7. Limitation of Liability

"As Is" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we will make every reasonable effort to provide timely and accurate price drop alerts, we do not guarantee the accuracy, completeness, or reliability of any information provided.

No Guarantee of Alerts: We are not responsible if a price drop occurs and we fail to alert you for any reason, including but not limited to technical errors, website changes on the monitored retail site, or other unforeseen circumstances. We are not liable for any missed savings or opportunities. Your reliance on the information provided by the Service is solely at your own risk.

Indemnification: You agree to indemnify and hold harmless Frugalux and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

8. Payments and Subscriptions

• Billing: For paid tiers, you will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the subscription plan you select.
• Cancellation: You may cancel your subscription at any time. The cancellation will take effect at the end of the current Billing Cycle. You will not receive a refund for the fees you already paid for your current Billing Cycle.
• Fee Changes: Frugalux, in its sole discretion and at any time, may modify the subscription fees. Any subscription fee change will become effective at the end of the then-current Billing Cycle.

9. Intellectual Property

All content and materials available on the Service, including but not limited to text, graphics, website name, code, images, and logos are the intellectual property of Frugalux, and are protected by applicable copyright and trademark law.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of California in the United States of America, without regard to its conflict of law provisions.
